Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") are a binding agreement between you and FitIn App LLC (DBA stayfor) ("stayfor," "we," "us," or "our") governing your access to and use of the stayfor mobile application, website, and related services (collectively, the "Service"). By creating an account, booking a class, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

If you are using the Service on behalf of a business or other entity, you represent that you have authority to bind that entity to these Terms.

2. Eligibility

You must be at least 18 years old to create an account and book a class. By creating an account, you represent that you are 18 or older and that all information you provide is accurate and complete.

3. What stayfor Is

stayfor operates a platform that connects users with independent fitness instructors, studios, and event hosts ("Instructors") who offer classes, sessions, and events ("Classes") through the Service. stayfor is not itself a gym, studio, or fitness instructor (except where stayfor or its own staff directly host a Class, in which case the same terms in this Agreement, including Section 8, apply). Instructors are independent of stayfor and are not stayfor's employees, agents, or partners. stayfor does not supervise, control, or guarantee the conduct, qualifications, or safety practices of any Instructor or venue, and is not responsible for the acts or omissions of any Instructor, venue, or other user.

4. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at the contact information below if you suspect unauthorized use of your account. You may not share your account, impersonate another person, or create an account for anyone other than yourself.

5. Bookings, Payments, and Cancellations

Prices for Classes are set by the Instructor and displayed at the time of booking. Payments are processed by our third-party payment processor, Stripe; by booking a Class you also agree to Stripe's terms of service. stayfor may charge a service fee in addition to the Instructor's listed price.

Cancellation and refund policies are set on a per-Class basis and shown to you before you complete a booking. Unless a specific Class states otherwise, cancellations made less than 24 hours before the scheduled start time are not eligible for a refund. stayfor reserves the right to cancel or reschedule a Class (for example, if an Instructor cancels or a venue becomes unavailable) and will refund payments for Classes that stayfor cancels.

Referral credits, promotional codes, and similar incentives have no cash value, cannot be transferred or redeemed for cash, and may be modified or discontinued at any time.

6. Waitlists

If a Class is full, you may join a waitlist. Joining a waitlist does not reserve a spot or guarantee entry. If a spot opens up, we will attempt to notify waitlisted users by email, but spots are offered on a first-come, first-served basis and stayfor does not guarantee that any waitlisted user will be able to book.

7. User Conduct

When using the Service or attending a Class, you agree not to: violate any law; harass, threaten, or discriminate against any other user, Instructor, or staff member; provide false information; attempt to circumvent the Service to transact with an Instructor outside the platform for a Class discovered through stayfor; or interfere with the operation of the Service. We may suspend or terminate your account for violating this section.

8. Assumption of Risk, Release, and Waiver for Class Participation

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

8.1 Inherent Risk. Fitness classes and physical activity — including but not limited to Pilates, yoga, strength training, HIIT, dance, and other movement-based Classes booked through the Service — carry an inherent risk of physical injury, including serious injury, and in rare cases death. These risks include, without limitation, muscle strains, sprains, joint injuries, cardiovascular events, falls, and injuries caused by equipment, studio conditions, or the actions of other participants. You voluntarily choose to participate in Classes with full knowledge of these risks.

8.2 Health Representation. By booking a Class, you represent that you are physically fit and have no medical condition that would prevent you from safely participating, or that you have consulted a physician and been cleared to participate. You are responsible for choosing Classes appropriate to your fitness level and for telling the Instructor about any injury, condition, or limitation before class begins. Stop any activity that causes pain, dizziness, or discomfort and seek medical attention if needed.

8.3 Assumption of Risk. To the fullest extent permitted by law, you assume full responsibility for, and all risk of, personal injury, illness, death, or property damage arising from or related to your participation in a Class, whether caused by your own actions, the actions of another participant, the actions or omissions of an Instructor or venue, equipment, or premises conditions.

8.4 Release. To the fullest extent permitted by applicable law, you release and agree not to sue FitIn App LLC (DBA stayfor), its officers, employees, and affiliates, as well as the Instructors and venues you engage with through the Service, from any and all claims, demands, or causes of action arising out of ordinary negligence in connection with your participation in a Class. This release does not apply to, and nothing in these Terms limits liability for, gross negligence, recklessness, or willful or intentional misconduct, and nothing in these Terms waives any right or protection that cannot be waived under applicable law.

8.5 New York Participants. If you participate in a Class located in New York State, New York General Obligations Law § 5-326 may render portions of this release unenforceable with respect to certain recreational facilities that charge a fee for use. Nothing in this Section 8 is intended to waive any protection you have under that statute or other applicable law, and this Section should be read to apply only to the maximum extent such a release is enforceable under the law of the state where the Class takes place.

8.6 Minors. Classes are not intended for and may not be booked for anyone under 18.

9. Indemnification

You agree to indemnify and hold harmless FitIn App LLC (DBA stayfor) and its officers, employees, and affiliates from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. STAYFOR DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY INSTRUCTOR OR CLASS WILL MEET YOUR EXPECTATIONS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FITIN APP LLC (DBA STAYFOR) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. STAYFOR'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO STAYFOR IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $100. THIS SECTION DOES NOT LIMIT LIABILITY WHERE PROHIBITED BY LAW.

12. Intellectual Property

The Service, including its design, text, graphics, logos, and the stayfor name and marks, is owned by FitIn App LLC (DBA stayfor) or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our written permission.

13. Termination

You may stop using the Service and delete your account at any time from within the app. We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, Instructors, or stayfor.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in New York, New York, and you consent to the personal jurisdiction of those courts.
